This Agreement (the "Agreement") is a legal agreement between you and Tahoe Warm Welcome that states the terms and conditions under which you may receive Tahoe Warm Welcome online services and use the Tahoe Warm Welcome web site (the "Site"). Your use of the Tahoe Warm Welcome online service and the Site constitutes your agreement to the terms and conditions set forth below.

Acceptance
By submitting a completed order form, you offer to purchase, pursuant to these Terms and Conditions and the order form, the groceries and other items (collectively, "Product") you select and submit to tahoewarmwelcome.com for purchase via the order form. Tahoe Warm Welcome may accept your offer by sending you and electronic confirmation that your order has been received and accepted. Tahoe Warm Welcome will also verbally confirm your order to ensure accuracy and satisfaction. If Tahoe Warm Welcome accepts your offer, these Terms and Conditions and the order form collectively constitute a legal agreement between Tahoe Warm Welcome and you governing your purchase of the Product from Tahoe Warm Welcome over the tahoewarmwelcome.com online shopping service.
Responsibilities
If Tahoe Warm Welcome accepts your order, Tahoe Warm Welcome shall, in return for your payment, provide the Product that you order through the online shopping service. The Product shall be delivered to you by an employee of Tahoe Warm Welcome, at the delivery address you designate. If shipment of your product is outside of our normal delivery area, the South Shore area of the Lake Tahoe Basin from Camp Richardson to Glenbrook, you will be responsible for shipping and handling, to the destination. Your payment for the Product, shipping and/or delivery, including any applicable sales taxes, is due upon completion of the transaction. Tahoe Warm Welcome will charge the payment for Product to the credit card that you submit to Tahoe Warm Welcome as part of your registration, and will collect the payment from your bank. You authorize Tahoe Warm Welcome to make and collect such payment and charge, and agree to make payment to Tahoe Warm Welcome. If Tahoe Warm Welcome cannot collect the charge for any reason. The total amounts you shall pay for the Product per each order shall be the sums of the respective prices for the items you select and submit via the online order form, plus all applicable sales taxes and shipping and/or delivery charges, if any, as reported to you as the "Total" in the delivery receipt.
Delivery
If Alcohol and/or Tobacco Products are part of the order, an adult 21 years of age or older must be present to accept the delivery. Buyers must be in compliance with all state laws within their own state and are stating their awareness of those state laws. By ordering you are also certifying that you are 21 years or older.
Shopper Registration
You agree to complete the initial registration process according to the Tahoe Warm Welcome requirements stated on the Web site, and to provide Tahoe Warm Welcome with accurate, complete and updated information as required for the initial registration process, including, but not limited to, your legal name, billing and delivery address, e-mail address, and appropriate telephone contact numbers. During the follow up phone call to complete the registration process, you must provide Tahoe Warm Welcome with an accurate and complete credit card number, expiration date and security code of the credit card. (MasterCard and Visa - 3 digit code is located on the back of the card; American Express - 4 digit code is located on the front of the card)
You represent and warrant to Tahoe Warm Welcome that your use of any credit card is authorized and legal. Upon completion of the transaction any balance due will be charged to the credit card we have on file for your account via the Paypal payments processing system.
Methods of Payment
You may pay by any American Express, MasterCard, and Visa or Discover. Authority for payment must be given at the time of order.
Tahoe Warm Welcome Satisfaction Guarantee
If you are not satisfied with an item for any reason, please call 530-541-1372. If an item is missing from your order, please notify us no later than 24 hours from the time of delivery for a full refund. Alcoholic Beverages, tobacco products and baby formula may not be returned after delivery has been accepted.
Confidentiality
Tahoe Warm Welcome does not sell or lease personally identifying information to any other company, person or agency. Information will only be released to a Court of Law if ordered to do so.
Cancellation Policies
Grocery, Alcohol and Tobacco Cancellation Policy:
All web placed orders are considered final. No refunds will be made. All pre-paid specialty requests will be eligible for a full refund if made 7 days prior to the original date reserved. Grocery Orders require at least a 24 hour notice to fill. Cancellations of grocery orders must be 48 hours prior to delivery date and time.
Substitutions
You agree that because of the nature of the Internet, the online shopping service is provided on an "As Is" and "As Available" basis. We are not liable to you if we are unable to supply a particular item. When ordering with us, you give Tahoe Warm Welcome permission to substitute an item for a like item if it is out of stock. If you are not satisfied with the substitution selected, you may contact Tahoe Warm Welcome for a refund of the "substituted item". Whenever possible, Tahoe Warm Welcome will attempt to contact you via telephone/e-mail should a substitution be necessary.
Limitations
Tahoe Warm Welcome and its affiliates will in no event be liable for any damages or losses, including, without limitation, direct, indirect, consequential, special, incidental or punitive damages for loss of data, income or profit, loss of or damage to property and claims of third parties resulting from or caused by your use of our web site, our web site's content, and any services or products delivered as a result of your use of our web site. Tahoe Warm Welcome shall not be liable to you for any interception of online communications, software or hardware problems (including, without limitation, viruses, loss of data, or compatibility conflicts) unauthorized use of your credit card, or other consequence beyond the reasonable control of Tahoe Warm Welcome. Any liability of Tahoe Warm Welcome (including its employees, affiliates, or agents) to you for damages, injuries, losses and causes of action, of any kind or nature, whether in contract, tort, or otherwise, either jointly or severally, shall be strictly limited to the aggregate dollar amount paid by you to Tahoe Warm Welcome in your most recent use of the online shopping service immediately prior to the claimed injury, loss or damage.
